NimboStar

Terms of Use

These terms are an agreement between you, the parent or guardian who creates a NimboStar account, and Pix Technology LLC, which operates NimboStar (“NimboStar”, “we”). By creating an account or using the site you agree to them, and to our Privacy Policy, which explains how we handle your family's information. If you don't agree, please don't use NimboStar.

Your account

  • You must be 18 or older to create an account.
  • Give us a real email address that you control, and keep it up to date so we can reach you.
  • Keep your password and parent PIN to yourself. You are responsible for what happens in your account, so tell us right away if you think someone else has used it.
  • An account is for one household. Please don't share it with other families.

Your learners

  • Add only children you are the parent or legal guardian of. By adding a learner, you give the consent described in our Privacy Policy on their behalf.
  • Children use NimboStar only through your account and under your supervision.
  • The leaderboard is off when you add a learner and can be turned on or off on their profile page. Please choose a nickname rather than a full name; other families never see it.

Using NimboStar

NimboStar is for personal, non-commercial learning. Please don't:

  • try to break, overload or get around the site's security, limits or parent PIN;
  • use bots, scrapers or other automated tools, or copy questions or answers in bulk;
  • reverse engineer the site, except where the law allows it;
  • access other families' information, or pretend to be someone else;
  • resell access to NimboStar or use it to run a tutoring or teaching business; or
  • use NimboStar in any way that breaks the law or harms others.

Our content

The questions, explanations, artwork, design and software are owned by NimboStar and protected by copyright and other laws. While your account is open, we give you a personal, non-transferable permission to use them for your family's learning, including printing an occasional page for your own children. All other rights are reserved.

Feedback and reports

If you send us a problem report, idea or other feedback, we may use it to improve NimboStar without owing you anything. We use problem reports only to fix questions, as our Privacy Policy explains.

Price

NimboStar is free right now. If we offer paid plans later, we'll show the price, how billing and renewal work, how to cancel and our refund policy clearly before you buy, and we'll never charge you without your agreement. Features that are free when you sign up won't become paid without notice to you first.

If you believe something on NimboStar infringes your copyright, email hello@nimbostar.com with: the work you believe is infringed; where it appears on NimboStar; your contact details; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you own or are authorized to act for the copyright owner; and your physical or electronic signature.

Changes

We keep improving NimboStar, so features may be added, changed or removed. We try to keep the site available but can't promise it will always be uninterrupted or error-free. If we change these terms in an important way, we'll show you what changed and ask you to accept it before you continue; the date at the top shows when they last changed.

Ending your account

You can delete your account at any time on the Account page; your data is then deleted as our Privacy Policy describes. We may suspend or close an account that breaks these terms or puts other families or the site at risk; where we reasonably can, we'll tell you why first. If we ever shut NimboStar down, we'll give parents notice and time to get a copy of their data.

Disclaimers

NimboStar supports, but doesn't replace, school, teachers and parents. We work hard to make every question correct, but mistakes can happen; please report them with the button on the question. To the extent the law allows, NimboStar is provided “as is” and “as available”, without warranties of any kind, including that it will meet a particular learning goal.

Limitation of liability

To the extent the law allows, NimboStar isn't liable for indirect, incidental, special or consequential losses, or for lost data or profits, arising from your use of the site. Our total liability for any claim about NimboStar is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Some places don't allow these limits, so they may not apply to you; nothing in these terms limits rights you have by law that can't be limited.

If you break these terms or the law, for example by adding a child you aren't authorized to add, you agree to cover reasonable costs that others' claims against NimboStar cause as a result.

Disputes

If something goes wrong, please contact us first. Most problems can be sorted out quickly, and we'll try in good faith for at least 60 days to resolve a dispute informally before either of us goes to court. Either of us may still bring a claim in small claims court.

General

  • These terms and our Privacy Policy are the whole agreement between you and NimboStar about the site.
  • If any part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a part of these terms right away, we can still enforce it later.
  • You can't transfer your account to someone else. We may transfer these terms if NimboStar is merged or sold, and the Privacy Policy explains how your information is protected if that happens.
  • We aren't responsible for delays or outages caused by events outside our reasonable control.
